Warranty Against Defects
This Warranty is given by Super A-Mart Pty Ltd ACN 009 810 324 (“Super Amart”).

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
OUR WARRANTY

In this document:
- “Aluminium Outdoor Product” means an outdoor furniture Product with an aluminium frame; /li>
- “Leather Upholstered Product” means a Product which is upholstered with 100% leather;
- “Product” means a product sold or supplied by Super Amart to You directly as a consumer;
- “Super Amart”, “Us” or “Our” means Super A-Mart Pty Ltd ACN 009 810 324;
- “Fabric Upholstered Product” means a Product which is upholstered with fabric or bonded leather;
- “Warranty Period” has the meaning given to that term in clause 3; and
- “You” means the person to whom the Product has been sold or supplied by Us.
- This Warranty is in addition to all of the rights you have under the ACL.

In addition to any other guarantee or warranty implied by law, Super Amart warrants that from the date of purchase, Products will be free from
defects in workmanship and materials for the following periods (each a “Warranty Period”):
- For the structural components (frame, foam foundation and mechanisms) of a Leather Upholstered Product, a period of 10 years.
- For the structural components (frame, foam foundation and mechanisms) of a Fabric Upholstered Product, a period of 5 years.
- For the upholstery of a Leather Upholstered Product, a period of 2 years.
- For the upholstery of a Fabric Upholstered Product a period of 1 year.
- For electric motors installed in either Leather Upholstered Products or Fabric Upholstered Products, a period of 5 years.
- For the structural components of an Aluminium Outdoor Product, a period of 5 years.
- or the structural components of BBQ’s (excludes burners, plates and grills), a period of five (5) years.
- For all other Products, a period of one (1) year.
- Unless excluded under clause 7, this Warranty covers all parts and materials of the Product found to be defective in workmanship or materials during the applicable Warranty Period.
- Where a defect in the Product is identified within the Warranty Period which constitutes a “major failure” (as defined in the ACL), you are entitled to a replacement or refund and for compensation for any other reasonably foreseeable loss or damage.
- Where a defect in the Product is identified within the Warranty Period which does not constitute a “major failure”, Super Amart’s liability is limited to, at Our option, providing a refund, replacing the Product or having the Product repaired. Super Amart’s liability under this Warranty does not extend to:
- damage, failure, fading or loss or deterioration of finish quality caused by normal wear and tear; or
- damage caused by improper use, assembly, maintenance or storage of this Product; or
- corrosion cause by improper care or improper maintenance; or
- damage caused in circumstances where the Product has been used commercially; or
- breakage or damage to glass table tops or mirrors; or
- Products sold “as is” where there is a patent or visible defect in the Product or a defect which has been brought to your attention prior to purchase.

To make a claim under this Warranty, simply follow these steps:
- a. Locate your receipt (or other proof of purchase acceptable to Us) which proves the date on which you purchased the defective product. Where the date of purchase cannot be verified Super Amart will estimate the date based on the date of manufacture, the condition of the Product and the type of defect.

- As this Warranty provides you with valuable rights in relation to the Product (and to ensure ease of processing any future Warranty claim) you should retain this document together with your proof of purchase securely.
